Bronx Supreme Court vacates CAL client's murder conviction, finding that the prosecution failed to disclose material exculpatory evidence reflecting on an investigating detective's credibility.
At Frederick W‘s trial, the prosecution relied heavily on an alleged confession made to a detective. The defense contended that the detective’s recounting of Frederick W’s statement had been falsified. Records showed that there were 16 Civilian Complaint Review Board allegations of misconduct against the detective, and three civil lawsuits, two of which alleged that the detective fabricated false confessions against the plaintiffs. The prosecution disclosed none of this. Following a hearing, the court held that the prosecution violated its Brady obligations, warranting a new trial.
