On December 2, 2021, the Appellate Division, First Department reversed M.T's conviction and ordered a new trial, as the record did not support the dismissal of two jurors as grossly unqualified for prematurely discussing the case. The court should have performed an inquiry to ascertain whether the jurors could render an impartial verdict, rather than discharging as grossly unqualified based solely on their misconduct.
