On December 2, 2021, the Appellate Division, First Department reversed D.H's conviction for persistent sexual abuse and dismissed the indictment, finding the charging instrument jurisdictionally defective because it did not specify which of the three statutory qualifying offenses he was alleged to have committed. Matthew Christiana represented D.H. on appeal.
