Ms. M was charged in a misdemeanor complaint with assault in the third degree. Although she was never held from grand-jury action on any offense, she subsequently waived indictment and pleaded guilty to assault in the third degree as a hate crime, a felony. AD1 found the conviction jurisdictionally invalid because Ms. M was never held for Grand Jury action on any charge, and the SCI improperly charged a greater offense than those charged in the criminal complaint.
