NY Supreme Court vacates CAL client's murder conviction finding client received ineffective assistance of counsel

Mr. J was convicted of second-degree murder for the 2015 killing of a 17-year-old and later sentenced to 40 years to life imprisonment. The prosecution’s theory was that Mr. J participated in the killing as a part of the drug organization that he was alleged to be a part of. Following a factual hearing on Mr. J's CPL 440.10 motion, Supreme Court Justice Daniel Conviser agreed with CAL’s contentions, among others, that defense counsel was ineffective for failing to move to controvert a search warrant for Mr. J’s cell phone and failing to present evidence that someone else had committed the murder.
